Card Rewards Program Terms and Conditions

These Ampla Card Rewards Program Terms and Conditions (‘Reward Program Terms and Conditions’) govern your eligibility for and participation in the Ampla Charge Card Rewards Program (‘Rewards Program’) and form an agreement between the business that is the Ampla account holder (“you”) and Ampla Technologies LLC (‘Ampla’, ‘Us’, ‘We’). The Rewards Program enables you to earn cashback rewards on eligible purchases (the “Cashback Rewards”). Terms not defined here will have the meanings ascribed to them in the Ampla Terms of Service or Business Deposit Account Agreement.

We may make changes to the Rewards Program, including discontinuation or suspension of the Rewards Program, at any time with or without notice to you by posting an updated version of these Reward Program Terms and Conditions on the Ampla website. The last updated date on the top of these terms will notify you of any recent changes or amendments to the Rewards Program. Continued participation in the Rewards Program after any such change constitutes your agreement to be bound by the amended Reward Program Terms and Conditions. If you no longer wish to participate in the Rewards Program, you must close your Ampla Account.

To be eligible for the Rewards Program, you must have an open Ampla Account in good standing and be a Charge Card cardholder at Ampla. This means you must have an Ampla ‘Charge Card’ (‘Card’). You are automatically enrolled upon activation of your Card at no cost to you. Ampla may change Card eligibility at any time, and at our sole discretion. To be considered in good standing, you must have an active Ampla Account and must not have any past due payments owed to us.

If your Ampla Account is not in good standing for any reason, or we determine in our sole discretion that you are either in violation of any of the Reward Program Terms and Conditions or any other agreements you have with us, any of our policies, or are abusing or misusing the Rewards Program, you may be ineligible to earn or redeem Cashback Rewards and may forfeit any Cashback Rewards previously earned. We have the sole discretion to restrict, limit or revoke the Cashback Rewards.

The Cashback Rewards accrue to the Ampla Account itself and not the individual users who use a Card. If there are multiple users linked to a single Ampla Account, those individual Users will not be eligible to receive Cashback Rewards, instead Cashback Rewards will be attributed only to the Ampla Account

Ampla is not responsible for informing you about any taxes you may owe. You are solely responsible for identifying and paying any taxes that may apply to the redemption or use of Cashback Rewards. Ampla will not report any income or earnings related to Cashback Rewards to a taxing authority, except where expressly required by law.

The Cashback Rewards you earn are not your property until the Cashback Rewards are issued to you which will be five business days after the close of your statement period. You must actively redeem your Cashback Rewards by either transferring them to your bank account or using them to make a payment towards your Card credit balance. You may redeem once the dollar equivalent of your Cashback Rewards has reached $50 (fifty dollars). Cashback Rewards cannot be sold, transferred or otherwise reassigned.

Cashback Rewards are not the property of any individual employee, agent, or representative of the business that is the Ampla Account owner. Cashback Rewards may only be redeemed by individuals authorized to act on behalf of the Ampla Account owner.

You hereby release Ampla, its subsidiaries, affiliates, assigns, and partners from any liability for your participation in the Rewards Program, use of Cashback Rewards, or your inability to to receive Cashback Rewards. Neither Ampla, nor any parties affiliated or related to Ampla, will be liable or responsible to you or any third party for any losses incurred by you as a result of your participation in the Rewards Program, use of Cashback Rewards, or your inability to receive Cashback Rewards.

The Cashback Rewards Program allows you to accrue Cashback Rewards when you make a Qualifying Purchase (as defined below) on a Card. You must use your Card to earn Cashback Rewards. You will not be eligible to receive any Cashback Rewards for purchases or payments not made with your Card.

The Rewards Program allows you to earn up to 1.5% of the total dollar value of Qualifying Purchases in any given statement period. The Cashback Rewards may be redeemable for cash or a statement credit. Ampla reserves the right to change the percentage of the Cashback Rewards you may earn at any time in its sole discretion.

A “Qualifying Purchase” is any purchase made with your Card excluding any fees or fines paid to Ampla, cash advances, balance transfers, purchases of cash equivalents such as gift cards, prepaid cards or reloadable prepaid cards, lottery tickets, digital currencies, person-to-person payments, person-to-person transfers, transactions deemed fraudulent, disputed or unauthorized transactions, transactions that we deem were not made in good faith as arms length transactions (e.g., self-dealing), transactions subject to a chargeback, reversal of previous transactions, refunded transactions, items returned for credit or any transactions defined by Visa MCC code as occurring at a Money Transfer or Stamp and Coin Stores.

For any transaction that does not qualify as a Qualifying Purchase, but for which you have already received Cashback Rewards, we may offset such Cashback Rewards using your remaining or future Cashback Rewards balance.

You are responsible for determining if your Cashback Rewards balance is correct. If you find an error or if you would like to dispute your Cashback Rewards, such dispute must be reported to Ampla within sixty (60) days from the date the account statement containing the potential error was issued to you. If you do not report the error with the (60) day period, you will forfeit the right to contest the balance.

If we determine, in our sole judgment, that you misused or abused this Rewards Program, we can immediately temporarily suspend your ability to use or earn Cashback Rewards, cancel your Card or close your Ampla Account, and cancel your accrued Cashback Rewards. Upon termination of your Ampla Account or termination of your Card, your accrued Cashback Rewards will be forfeited, subject to any grace period that Ampla may offer to you in its sole discretion to redeem your Cashback Rewards.
